What do I need to do to get the expenditure period extended for my project in an Opportunity Zone, which has been affected by a federally declared disaster?

    The following is not to be deemed legal advice and is only informative. Generally speaking, the safe harbor written plan should be amended assuming the initial safe harbor plan was adopted in 2019 or 2020. The COVID extensions may add an additional 24 months to 31 months in the initial plan. The QOZB would have to have been complying with the initial plan at time of extension. QOFs have separate extensions.

    Consult the IRS Notice related to the disaster, and reconcile it with Section 7508A of the Code. That'll tell you how much of an extension you get.

    According to various IRS notices issued (2021-10 and 2020-39), if you are covered by the federal disaster areas designations and comply with the requirements, you do not need to file any additional form or schedule.
