    You would have to file an amended return and otherwise have a qualifying investment.

    Presuming you are doing it under the auspices of the IRS Notice on the subject, you'd just amend your income tax return.

    It simply requires an amendment of that previously filed tax return. You would need additional reporting on Schedule D to show the deferral of the gain and to also include Form 8997 to disclose your QOF investments.

    As long as you are still within your deferral window, you can file an amended return to record your investment in a QOF.
