    I'm not really sure what "custody rule" you are referring to. Are you referring to custody of real property? Is this something to do with an exchange accommodator on a 1031 exchange? Are you referring to cash proceeds from the sale? If cash, it is not an issue. You have 180 days from the date of the sale (or later in certain circumstances to be discussed with a qualified advisor) to reinvest the proceeds into a QOF. And yes, you can have "custody" of the cash, if that's what you are asking. It does not go through an exchange accommodator like in a 1031 exchange.
